Exploding Targets Creating A Buzz In Morrow County

Exploding targets have become very popular with gun enthuisiasts throughout the state of Ohio this year, largely because they are relatively inexpensive and can be purchased over the counter without a liscence. However, these devices have created quite a buzz in Morrow County as of late, but the uncertainty behind exactly what is contained in the product has constructed a problem all its own.

Morrow County Sheriff Steve Brenneman voiced his concern to county prosecutor Charles Howland earlier this year about exploding targets because of a number of complaints raised by residents. Howland responded in March, concluding that using exploding targets is a violation of Ohio Revised Code 2923.17 that states:

No person shall manufacture or process an explosive at any location in this state unless the person first has been issued a liscence, certificate of registration or permit to do so from a fire official of a political subdivision of this state or from the office of the fire marshall.

But the problem for law enforcement is that exploding targets are not illegal when they're purchased, but become illegal when the contents are mixed together.

"When you purchase these exploding targets they're not mixed so they are not at that time explosives." Brenneman says. "Once you start mixing them you've processed a high explosive."

Brenneman compares explosive targets to fireworks, which are legal to purchase in Ohio but cannot be set off without a liscence. He says as of now that repeat offenders with explosive targets will be issued a ticket for disorderly conduct, but Howland says there are many factors to consider before charging an individual who uses these devices.

"We need more research and analysis of the chemicals being used. "Howland says. "We would consider all factors before issuing a charge."

And Howland indicated in his letter to Brenneman that charges could be as severe as a second degree felony, although no felony charges have been made in regards to explosive targets as of yet in Morrow County.
