Aurora Shooting Suspect James Holmes Back In Court

  Original Published: 5/14/2013  Aurora, Colorado shooting suspect James Holmes appeared in court Monday.   His attorneys asked for a change of plea, from "not guilty" to "not guilty by reason of insanity."    Marshall Zelinger has the details.   No cameras in the courtroom again as James Holmes appears in handcuffs with a bushy beard, his attorneys telling the judge why they want permission to change his plea, saying they now have a complete diagnosis, and an opinion from a qualified professional that he is not guilty by reason of insanity.   Though they provided no details.   The judge allowing Holmes a chance to change his plea, saying it would be consistent with fairness and justice.   But the hearing ended without Holmes changing his plea because his attorneys still want clarification on what happens when he gets evaluated at the state mental hospital.   "The statute itself, just the insanity statute hoes on for 35-some pages," sayd legal analyst Dan Recht.   Recht explains the insanity statute has guidance but not firm rules for every case, rules the defense wants spelled out before they change the plea.   "If you choose not to talk about the event because you have a Fifth Amendment right not to, is that cooperating or is that not cooperating? Recht asked.   Not cooperating would mean the defense could not call witnesses to talk about Holmes' mental condition.   James Holmes' mother attended the hearing in person, watching from the row in front. She did not show any reaction during any of the proceeding.
